Terms of Use

Welcome to Roux. These Terms of Use ("Terms") govern your access to and use of the Roux mobile application and related services (collectively, the "Service") operated by Roux Studios ("Roux," "we," "us," or "our"). By downloading, accessing, or using Roux, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

1. Definitions

• "Service" refers to the Roux mobile application and any related services provided by Roux Studios.
• "User Content" refers to recipes, notes, images, meal plans, voice queries and transcriptions, or other materials submitted or stored by users within the Service.
• "User" or "you" refers to any individual accessing or using the Service.

2. The Roux Service

Roux is a cooking assistant designed to help users organize recipes, plan meals, generate shopping lists, and receive guidance while cooking. The Service may allow users to:

• Import recipes from links or pasted text
• Save and organize recipes
• Create meal plans
• Generate grocery lists
• Ask cooking questions through voice or text
• Share images during cooking for guidance

Certain features rely on automated systems, including artificial intelligence, to generate responses or suggestions. Roux may update, modify, or discontinue features of the Service at any time.

3. Eligibility

You must be at least 13 years old to use Roux. By using the Service, you represent that you meet this age requirement and have the legal capacity to agree to these Terms. If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Service.

4. License to Use Roux

Subject to these Terms, Roux Studios grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Roux application for your personal, non-commercial use. You may not:

• Copy or distribute the application
• Modify the software
• Reverse engineer or attempt to extract the source code
• Use the Service for commercial exploitation without permission

All rights not expressly granted in these Terms are reserved by Roux Studios.

5. User Accounts

Certain features may require the creation of a user account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to update that information as necessary. Roux reserves the right to suspend or terminate accounts that violate these Terms.

6. User Content and Recipes

Roux allows users to store and organize content such as recipes, notes, meal plans, images, and other materials. You retain ownership of your User Content. However, by submitting content to the Service, you grant Roux a limited license to store, process, and analyze that content as necessary to provide the Service.

Roux also allows users to import recipes from external sources such as websites or pasted text. You are responsible for ensuring that your use of such material complies with applicable laws and does not infringe the rights of others. Roux does not guarantee the completeness, formatting, or accuracy of imported recipes.

7. Artificial Intelligence Features

Certain features of Roux rely on artificial intelligence systems to generate responses or suggestions. AI-generated responses may be incomplete, inaccurate, or inappropriate for specific cooking situations. The information provided through the Service is intended as general cooking guidance only. Users should exercise their own judgment when preparing food and should verify important information before relying on it.

8. Cooking and Food Safety Disclaimer

Cooking involves inherent risks, including food safety concerns and the potential for allergic reactions. Roux does not guarantee that any recipe, instruction, or suggestion is safe or appropriate for every situation. Users are responsible for ensuring that food is prepared safely, ingredients are handled properly, and cooking instructions are followed responsibly. Roux does not provide medical or nutritional advice.

9. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Upload illegal or harmful content
• Infringe the rights of others
• Interfere with the operation of the Service
• Attempt to access restricted areas of the application
• Scrape or extract data from the Service
• Misuse artificial intelligence features

Roux reserves the right to suspend or terminate accounts that violate these rules.

10. Intellectual Property

The Roux application, including its software, design, graphics, and other content (excluding User Content), is owned by Roux Studios and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our permission.

11. Third-Party Services

Roux may rely on third-party providers to operate certain features of the Service, including artificial intelligence systems, analytics providers, web search services, speech recognition services, and cloud infrastructure. Your use of the Service may involve data being processed by these third-party providers.

12. Service Availability

The Service is provided on an "as is" and "as available" basis. Roux does not guarantee that the Service will be uninterrupted, secure, or free of errors. We may modify, suspend, or discontinue parts of the Service at any time without notice.

13. Disclaimer of Warranties

To the fullest extent permitted by law, Roux Studios disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Roux does not guarantee that:

• The Service will meet your expectations
• The information provided will be accurate or complete
• The Service will be free from interruptions or errors

Your use of the Service is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by law, Roux Studios and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. This includes damages related to cooking outcomes, food preparation, reliance on AI-generated suggestions, inaccuracies in recipes or imported content, loss of data, and service interruptions.

In no event will Roux Studios' total liability exceed $100 USD or the amount you paid for the Service in the previous twelve months, whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Roux Studios and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. When changes occur, the updated version will be posted within the app or on our website along with a revised "Last Updated" date. Continued use of the Service after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in courts located in Washington, DC.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Roux Studios regarding the Service and supersede any prior agreements or understandings.
